Creating an account, placing an order, or using any data we supply is acceptance of these terms. If you do not agree, do not order and do not use the data.
Data supplied by Aged MCA Data is licensed, not sold outright. A purchase grants the buyer a non-exclusive, non-transferable, revocable licence to use the records for the buyer's own business-to-business commercial outreach. Aged data is explicitly non-exclusive and is licensed to more than one buyer.
Records may be used to contact a business about commercial financing and related business services. Records may not be resold, sublicensed, redistributed, or posted publicly, and may not be appended to a list offered for sale.
Records may not be used for any purpose governed by the Fair Credit Reporting Act, including consumer credit, employment, insurance underwriting or tenant screening. Records may not be used to contact consumers in a personal capacity, or for any unlawful, deceptive or harassing purpose.
The buyer is solely responsible for the lawfulness of its own outreach, including obligations under the Telephone Consumer Protection Act, federal and state do-not-call rules, state calling-time restrictions, and applicable messaging and email regulations. We do not represent that any record is scrubbed against any do-not-call registry. Scrub before you dial.
Aged MCA Data is not a consumer reporting agency and the data is not a consumer report within the meaning of the Fair Credit Reporting Act. Nothing we supply may be used, in whole or in part, as a factor in determining any individual's eligibility for credit, insurance, employment, housing or any other purpose covered by that Act.
Orders are paid in advance by Zelle or bank transfer (wire or ACH). Minimum order $200. An order that has not been paid within 48 hours is cancelled automatically. Zelle and bank transfers are initiated by you and cannot be reversed once sent; you are responsible for sending the correct amount to the address shown on your order page, and we are not responsible for payments sent elsewhere. Delivery is a CSV file released once we have confirmed receipt of payment; it remains downloadable from your account for 30 days. Because the product is data, orders are not refundable once delivered, except as set out under Replacements. If fewer records are deliverable than you paid for, we credit or refund the difference.
We replace hard bounces and disconnected numbers above the coverage rate stated for a list, reported within seven days of delivery, by credit or replacement records at our option. This is the buyer's sole remedy for data quality.
Except for the replacement commitment above, data is supplied "as is" and "as available". We make no warranty, express or implied, as to the accuracy, completeness, currency, fitness for a particular purpose or merchantability of any record, and no representation about the current business status, funding status, intent or contactability of any business in a file. Record age refers only to the date a record entered our system. We make no representation about conversion, contact rates, funding rates or return on investment.
To the fullest extent permitted by law, our total liability arising out of or relating to any order, the data, or these terms, whether in contract, tort or otherwise, is limited to the fees the buyer paid for the order giving rise to the claim. We are not liable for any indirect, incidental, consequential, special or punitive damages, or for lost profits, revenue or business, even if advised of the possibility.
The buyer will defend, indemnify and hold harmless Aged MCA Data and its owners, officers and contractors from any claim, fine, penalty, loss or expense (including reasonable legal fees) arising out of the buyer's use of the data, including without limitation any claim under the Telephone Consumer Protection Act, federal or state do-not-call rules, the CAN-SPAM Act, state privacy laws, or any allegation that the buyer's outreach was unlawful, deceptive or harassing.
We may refuse or cancel any order, and terminate a buyer's account and licence, if we believe the data is being used in breach of these terms. Breach of the permitted-use or prohibited-use provisions terminates the licence immediately and the buyer must delete all data supplied.
These terms are governed by the laws of the State of SET_ME, without regard to its conflict-of-law rules, and any dispute will be brought exclusively in the state or federal courts located there.
These terms, together with the order confirmation, are the entire agreement between the buyer and Aged MCA Data for each order and supersede any prior discussion. If any provision is unenforceable, the remainder stands.
